Terms of service
Last updated
The short version: Banjo is for people 13 and over, coins are free and worth nothing outside the app, you may only star as yourself, and we act fast on abuse.
1. These terms
These terms are an agreement between you and UpLevel Technologies LLC (“Banjo”, “we”, “us”) for using the Banjo apps and bnjo.tv. By creating an account or using Banjo, you agree to them and to our privacy policy. If you don’t agree, please don’t use Banjo.
2. Who can use Banjo
You must be at least 13 to have an account. If you’re under the age of majority where you live, a parent or guardian must agree to these terms for you. Some stories and Starring you are only for members 18 and over.
Give accurate information, including your date of birth, when we ask. You can’t use Banjo if we’ve previously removed you, or if the law prohibits it.
3. Your account
Keep your sign-in secure and tell us at support@bnjo.tv if you think someone else has accessed your account. You’re responsible for what happens on your account. You can delete it at any time in the app.
4. Watching and interacting
We give you a personal, non-transferable, revocable license to watch and interact with stories in the app for your own non-commercial use. Stories belong to Banjo or the publishers who made them; don’t copy, record, redistribute or publicly show them.
In a live vote, watch party or audience vote, the result is decided by the people taking part, and the story follows it. Votes, predictions and results can be paused, voided or corrected if something goes wrong, for example a technical fault or manipulation.
5. Coins
Coins are free and have no cash value. You earn them by watching and playing; you can’t buy them, sell them or cash them out. Use them to predict what happens next and for Starring you. Every ending is free to explore.
Coins are a free-play feature, not money, property or a prize. They can’t be transferred between members, and they aren’t a form of gambling: nothing of value can be won. We may limit how many coins can be earned, and adjust balances to fix errors or abuse. Coins end when your account does, and if we discontinue them.
6. Starring you
Starring you lets verified members cast themselves in a personalized, AI-generated edition of a story. When you use it:
- You may only verify and use your own face. Never try to verify as, or cast, someone else without their permission.
- You agree to the separate likeness release in the app and our biometric data policy.
- Every edition is labeled AI-generated, in the picture, in the app and in its Content Credentials. Don’t remove or hide those labels, or present an edition as real footage.
- Don’t use an edition to deceive, harass, defame or sexualize anyone.
- You choose who can cast you, and you can revoke your likeness at any time.
You give us permission to use your reference image only to make the editions you request. Editions are for personal use; the story and its characters remain the publisher’s.
7. Community rules
Banjo is for everyone 13 and over. Don’t use it to:
- harass, bully, threaten or abuse anyone, or promote hate based on who people are;
- share sexual content involving minors, or intimate imagery of anyone without their consent, real or AI-generated;
- encourage self-harm or violence;
- impersonate people, or mislead others about who you are;
- spam, scam, or sell anything;
- break the law or infringe anyone’s rights;
- get around safety features, age limits or bans, manipulate votes or coins, or access Banjo with bots, scrapers or a modified app.
8. What you post
You keep ownership of what you post, like your profile, messages and group names. You give us a worldwide, non-exclusive, royalty-free license to host, show and process it to run Banjo, for as long as it’s on Banjo. Only post things you have the right to share.
9. Reports, moderation and appeals
You can report people, messages and personalized editions in the app, and block anyone. We review reports and may remove content, limit features or suspend or close accounts that break these terms.
If we act on your account or content, you can appeal once per decision in the app within 90 days. We aim to review appeals within 7 days.
To report intimate imagery of you shared without consent, including AI-generated imagery, use our takedown form. You don’t need an account, and we act on valid requests within 48 hours. Other safety concerns: safety@bnjo.tv.
10. Copyright
If you believe something on Banjo infringes your copyright, email safety@bnjo.tv with the work, where it appears on Banjo, your contact details, and a statement that you’re authorized to act and believe in good faith the use isn’t permitted. We remove infringing content and close the accounts of repeat infringers.
11. Changes to Banjo and these terms
Banjo will change: stories come and go, and features may be added or removed. If we change these terms in a way that matters, we’ll tell you in the app before the change takes effect. Continuing to use Banjo after that means you accept the new terms.
12. Ending this agreement
You can stop using Banjo and delete your account at any time. We may suspend or end your access if you break these terms, if the law requires it, or if we stop offering Banjo. Sections that by their nature should survive, like coins having no value, disclaimers and limits on liability, continue after the agreement ends.
13. Disclaimers and liability
Banjo is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise Banjo will be uninterrupted or error-free.
To the extent the law allows, we aren’t liable for indirect, incidental, special, consequential or punitive damages, and our total liability for any claim about Banjo is limited to US$100. Nothing in these terms limits liability that can’t be limited by law, or your rights as a consumer where you live.
14. Governing law
These terms are governed by the laws of the State of [to be confirmed by counsel], USA, without regard to conflict-of-law rules, except where the law where you live gives you the right to bring claims locally.
